1. About these Terms

These Terms of Use ("Terms") form a binding agreement between you ("Customer" or "you") and MGR Courier Service Limited, a company registered in Jamaica ("MGR", "we", "us"). By creating an account, requesting a quote, tendering cargo, or otherwise using our website, mobile applications or services (the "Services"), you agree to be bound by these Terms.

3. Accounts & security

You must keep your login credentials confidential and notify us immediately of any suspected unauthorized use. You are responsible for all activity on your account. Where we offer two-factor authentication, you are encouraged to enable it. We may suspend access where we reasonably believe the account is compromised.

4. Our services

We act as a freight forwarder, customs broker, and logistics platform connecting customers with carriers, brokers, and regulators. We do not act as a common carrier and, except where expressly stated, do not own the vessels, aircraft, or trucks that move your Cargo.

5. Broker authority & obligations

Where you engage our broker services, you appoint our licensed Customs Broker to act as your agent for the limited purposes set out in our Customer Brokerage Agreement, including lodging declarations, paying duties on your behalf with reimbursement, and corresponding with regulators. The broker shall act with reasonable skill and care, comply with the Customs Act, and disclose any conflict of interest.

You are solely responsible for the accuracy of the commercial invoice, packing list, HS classification, and origin declaration. Suggested HS codes generated by our platform are estimates and not legal advice. Tariffs, duties, and exchange rates change frequently; we do not warrant any duty estimate produced by our calculator. Final liability for duties, taxes, and penalties rests with the importer of record.

8. Fees, payment & lien

Quoted rates are valid only for the period stated and are subject to verification of weight, dimensions, and goods description. We may charge for advances we make on your behalf (duties, port charges, demurrage, permit fees) plus a reasonable disbursement fee. We reserve a general lien on all Cargo and documents in our possession or control for any sum due, whether incurred in respect of those particular goods or otherwise.

9. Limitation of liability

Subject to the mandatory liability rules of the Customs Act and the Carriage of Goods by Sea Act, our liability to you under or in connection with these Terms is capped at the lesser of (a) the brokerage / handling fees paid by you for the relevant transaction, or (b) the equivalent of two (2) Special Drawing Rights per kilogram of the Cargo affected, or (c) JMD 750,000 in aggregate per claim.

We are not liable for indirect, special, consequential or economic loss including loss of profit, loss of market, loss of business, or loss arising from delay, even where foreseeable. We do not insure your Cargo unless we have issued a written cargo insurance certificate. You are strongly advised to maintain marine / cargo insurance.

10. Indemnity

You will indemnify MGR, our directors, officers, employees, agents, brokers, carriers, and sub-contractors against all claims, losses, fines, penalties, duties and reasonable legal costs arising out of (i) your breach of these Terms, (ii) inaccurate or incomplete information supplied by you, (iii) your tender of restricted, prohibited, or undeclared goods, or (iv) your use of the Services in violation of law.

11. Prohibited goods & conduct

You may not tender, request transportation of, or use the Services for: narcotics or controlled substances except where licensed; firearms, ammunition or explosives without an approved Firearm Licensing Authority permit; counterfeit goods; goods subject to international sanctions; CITES-listed species without a permit; human or animal remains without prior written approval; or any other goods prohibited under Jamaica law. You may not attempt to scrape, reverse-engineer, or interfere with the Services, or use them to facilitate fraud.

12. Data & privacy

Your use of the Services is subject to our Privacy Policy. We process personal data lawfully under the Data Protection Act 2020 (Jamaica) and equivalent international frameworks where applicable. Where we suffer a personal data breach we will respond in accordance with our Data Breach Response Policy.

13. Suspension & termination

We may suspend or terminate your account immediately if you breach these Terms, fail to pay sums due, tender prohibited goods, or where required by law. Suspension or termination does not affect accrued rights or sums due.

14. Force majeure

Neither party is liable for delay or non-performance caused by events beyond reasonable control including hurricanes, earthquakes, floods, port closures, strikes, labour actions, government acts, sanctions, war, civil unrest, pandemic, network outages, or cyber-attack.

15. Governing law & disputes

These Terms are governed by the laws of Jamaica. Any dispute will first be referred to good-faith negotiation, then to mediation at the Dispute Resolution Foundation in Kingston, and failing resolution, to the exclusive jurisdiction of the courts of Jamaica. Customers outside Jamaica consent to jurisdiction in Jamaica for the purposes of disputes arising under these Terms.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and posted on this page at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
