Customs Brokerage Agreement

1. Appointment

The Customer hereby appoints the Broker as its lawful agent for customs purposes in respect of the consignments listed in Schedule A (or, where Schedule A is left blank, all future consignments lodged with the Broker until written revocation), with authority to:

• Lodge customs declarations (SAD / C78 / C73) and supporting forms;
• Pay duties, taxes, levies, and port charges on the Customer's behalf, with reimbursement;
• Receive customs queries and provide explanations and supporting documents;
• Apply for permits and licences specified by the Customer;
• Collect cleared goods, arrange transport, and re-deliver to the Customer.

2. Customer warranties

The Customer warrants that:

• All information supplied to the Broker is true, complete, and not misleading;
• The Customer has, or will obtain, all necessary permits and authorisations;
• The goods are not prohibited or restricted except as expressly disclosed;
• The Customer is the importer of record and accepts ultimate liability for all duties, GCT, SCT, fees, fines, and penalties.

3. Fees & advances

The Broker's fees are as quoted from time to time. The Customer authorises the Broker to advance payment to Customs, the carrier, ports, and regulators as required, and to invoice the Customer for the advanced amount plus a disbursement fee. Invoices are payable within seven (7) days. Unpaid amounts attract interest at 1.5% per month. The Broker has a general lien on all cargo and documents in its possession or control for any sum due.

4. Liability

The Broker's liability is limited as set out in our Liability Disclaimer and Terms of Use. The Customer acknowledges that those limitations form part of this agreement.

5. Indemnity

The Customer indemnifies the Broker against all duties, fines, penalties, demurrage, storage, claims, and reasonable legal costs arising from breach of this agreement, inaccurate or incomplete information, or undisclosed restricted goods.

6. Confidentiality & data

The Broker holds the Customer's information in confidence except where disclosure is required by Customs, TAJ, or other authorities, by court order, or to enforce this agreement. The Broker processes personal data in accordance with our Privacy Policy.

7. Term & termination

This agreement runs until terminated in writing by either party with seven (7) days' notice. Termination does not affect rights or obligations accrued before termination, including the Broker's lien and outstanding fees.

8. Dispute resolution

The parties will first attempt good-faith negotiation. Failing resolution within 30 days, disputes will be referred to mediation at the Dispute Resolution Foundation, Kingston. Failing resolution by mediation, the courts of Jamaica have exclusive jurisdiction.

9. Governing law

This agreement is governed by the laws of Jamaica.
